Legal Question in Workers Comp in Maryland

Injury to Knee

If you are awarded a partial settlement and medical for 5 years but were unable to find a dr. in your area accepting patience, then found one within time frame and the injury has become worse, then contacted your attorney and moved forward with work comp case but the employer wants you to settle for say less then $2,000.00. Would you be able to sue that employer for future medical costs in ref. to the injury and possible loss of wages due to medical treatment and would employer be responsible for medical treatment of injury for employees natural life?

Re: Injury to Knee

You cannot sue your employer for a work-related injury. You already worked out a settlement as to your disability, leaving open any medical expenses for 5 years. At this point your options are to accept a further settlement with the comp insurance in exchange for giving up your remaining medical coverage, or using that coverage for the remainder of the 5 year period.
