you need to discuss this in detail with an attorney who KNOWS workers' compensation. my partner has just been named a super lawyer for 2007. he practices only workers' comp. law. please visit our website at ihlaw.com

If the compensation carrier agrees to pay permanent partial disability benefits based on the ime rating, and you agree to accept that, you would be entitled to approximately 9 years of benefits, starting from when you last received temporary disability payments. Of course, if your own doctor thinks your disability rating is higher, you could try and negotiate a compromise or take the matter before a commission hearing and try to prevail there.
The amount of each weekly payment depends on both your average weekly wage, which should already be established, and the State Average Weekly Wage for the year of the accident, which is a published figure. You get 2/3 of your average weekly wage, which is probably what you've been getting in temporary benefits, but cannot receive more than 75% of the SAWW. You would also be entitled to ongoing medical benefits, but if you are willing to give those up (most likely a bad idea), the carrier will pay you something for doing so. You should definitely seek the assistance of an attorney familiar with the workers' compensation law to help you with this matter. If you would like to provide me with the additional information mentioned above, I could give you a more precise idea of your overall entitlement.
