Who are the parties to a contract for sale at retail?

In a retail transaction, such as purchasing from a well-known ''Big Box'' retailer, who are parties to the contract for sale? Surely the consumer and the retailer are parties. Is the manufacturer of the goods being sold also a party to the contract?

In terms of potential breach of contract claims, only the buyer and the retail store are parties to the contract. But if a product results in injury, then virtually any person who is injured by the product can bring a claim, and all businesses in the chain of distribution of that product, from the retailer on up to the manufacturer and every wholesaler in between, might be held liable for the injury.

The law in this area is complex; if someone has been hurt by a product, he or she should talk to a lawyer with experience in the field.

Usually yes! Paticularly under M.G.L.Chapter 93A.
