Legal Question in Criminal Law in Massachusetts
My wife was assulted by a former friend of ours in a bar recently. He went and filed assult and battery charges against her claiming she assulted him. This person has been to court several times, once for attempted kidnapping and has also had a number of restaining orders against him. all of these charges were over 5 years ago. I was told that his past court record can not be used as a defense in my wifes case due to the fact that they are over 5 years old. Is this true? Thanks

Bring all that up. Address the facts of the assault and have your wife file an application for a criminal complaint against him.
