Legal Question in Family Law in Massachusetts

child support to ex-spouse after child is 18 and in college

Is an ex-spouse who has been receiving child support payments, entitled to continued payments after the child is 18? The ex claims she is providing a home for the child, thus entitled. We are also providing a home for the child. The child will go to college and live there next fall.. My husband will pay his share of tuition, room, board, health, travel, etc. Should the money he contributes go directly to the child, or must it continue to go to the ex-spouse? The ex is not suffering for lack of funds.

You must obey the court order. Examine the judgment or separation agreement and see what it says about emancipation. Ordinarily, in Massachusetts, child support must be paid to the custodial parent until the child graduates from college or reaches age 23.
