Legal Question in Family Law in Massachusetts

the paternal grandfather has guardianship of my two daughters, their father lives with them but does not help or spend time with them has them in the middle of a completly disfunctional relationship, and is still using drugs around my kids, their grandmother is disabled and the grandfather is always traveling and if home drinking and fighting with his wife in front of my kids. i am having back surgery next week so i am not working and i am staying with family would i be able to have the guardianship removed and placed in a family shelter with me

It is doubtful you can get custody if you are in a shelter. If you have family who would take the kids in, that might be possible to get them moved.

If you request an investigation into the home conditions and the grandparents are found wanting and CSS detemines that they would be better-off elsewhere, then it is likely that they will be placed in foster care.

If you are able to live with family, you might get custody. Good luck with the surgery and your children.
