Legal Question in Insurance Law in Massachusetts

life insurance and 401k

my brother just recently died in mass... he left his life insurance & 401k to a friend..... is this legal or since i am his only living relative can the proceeds go to me?

First of all, please accept my condolences for the loss of your brother.

Unless there was some fraud or other untoward conduct, your brother was free to leave those assets (via contractual beneficiary designation) to whomever he wished.

You should hire an attorney here in Massachusetts to probate his estate and marshal any probate assets. Please do not hesitate to contact my office if I can be of any assistance.
