i bought my house for cash on june 30 2006my on agean off agean girlfriendof three years convinced me sign over half the house to her thru alachol and courison witch i finally did on sept7 2006 i am now out of the house with a restraning order for three months she is trying to steal my home what can i do

Let's talk. The are several issues at play here including whetehr there was proper consideration (or fraud) as well as your remaining property rights (to force the sale of the home). Restraining orders are a common tactic to utilize when trying to gain an advantage in the break up of a relationship that involves jointly held property (whether married or not). 978.250.4255

you should contact a real estate attorney as soon as possible. there is an issue of consideration and intent to make a gift. You can file a petition for partition to force the sale of the home or you can file a petition to remove her name from the title and ask for her eviction from the home. This all depends on the facts as you have presented them and it is not absolutely certain you will win, but you appear to have a very good case.

In addition to what the other fellows said, you may also be able to sue her for "rents" due to you if she's occupying the entire home. Restraining orders do not affect title to property, however, so in the least you'll retain the ownership of your half.

The facts you raise indeed are a problem. There are, as the other said, a number of ptions. All of these are going to force you into court.

The first thing you must do is to halt the sale of the house. This will require you to file an action and get a court order. If you delay, the problems can get worse.
