Valid or not

my husband and i purchased a home in november 2006 from a so called friend. the deal went sour at closing time and he refused to sell us the house if we did not sign a contract giving him 2yrs to remove his property from the house lot. We signed it but found out it was under false pretenses. He had violations on the property before we bought it and the town is taking him to court over it and it is in regards to the property left by him on the property. Our question is, since the property was already in violation, and we did not recieve full disclosure, is the contract he made us sign valid?

I am assuming that you did not have an attorney represent you at closing. I would be surprised if an attorney would have agreed with such a condition, absent other factors.

Whether a contract is valid or not depends upon the facts and circumstances surrounding its execution. Beyond that, you may have other potential claims against the seller, depending upon how the Purchase & Sale Agreement was worded. There may be other defenses to the "contract," again, depending upon facts and circumstances, including what the town's claims against him are. You would be wise to seek advice of legal counsel in your area.
