Legal Question in Bankruptcy in Michigan
Lost Deposit With Now Out-of-Business Company
Wanted to buy a hunting bow for my son. Went to local archery speciality store on 24 Sep 2003. Had to special order, paid $100 deposit on $180 bow until shipped to store for me to pick up, still have my receipt. Checked back several weeks later, bow finally came in. Wasn't able to get to store to pick up right away, called back a couple weeks later only to get a ''phone number no longer in service, no further information available'' message. Went by store, no one was there with lights off and place basically empty and signs on the door stating ''closed'' and ''out of business''. Just what do I need to do in order to re-coup this money? Thanks in advance for any help that you can provide me with in this matter.

You may be out of luck. I would first contact the Michigan CIS corporations division at 517.241.6470 to find get contact information for the corporation that owned the store. You can search for this information yourself at http://www.cis.state.mi.us/bcs_corp/sr_corp.asp. If you do not find a corporation listed as using the store name, then you can check at your county courthouse to determine whether there is an assumed name filing there. You can also search for information about the store using an ordinary search engine. Finding them will be half the battle. Once you contact them, ask them to refund your money. If they don't, you can take them to small claims court. You can also report them to the Michigan Attorney General at http://www.michigan.gov/ag/0,1607,7-164-17331-42077--,00.html . The bottom line, though, is that if they do not have the money, you won't be paid. Good luck.
