Legal Question in Credit and Debt Law in Michigan

Garnushment

I was served with a default judgment, I have filed a Motion to vacate. Can they still go for a garnishment? If so is it 10 or 21 days after a default judgment was served?

Re: Garnushment

I think they can still attempt to garnish. The creditor must wait until 21 days after the date the judgment was entered. In the meantime, you may want to take some actions to protect bank accounts from garnishment.

Whether or not your motion to set aside the judgment will be successful will depend on whether you have grounds, whether or not the motion was timely, and whether or not you provided the required affidavit with a meritorious defense.
