Employee Discrimination

I was called to return to work for my previous employer, so I left my current job to return. After my 90 days I completed the paperwork to reinstate my medical insurance benefits. After several weeks I asked about the status of my medical insurance and was told that the insurance company would not reinstate my benefits due to the fact that another person in the company on the policy has a terminal illness. No compensation was received for the lack of this benefit. Is is legal to provide medical insurance to some employees and not to others?

This company fired me because they found out that I was seeking other employment which would provide medical benefits. Is it leagal to fire a person for this reason?

I do not know if it is illegal to deny medical insurance to someone who is terminally ill. Call the State Insurance Commissioner with this inquiry. Howevr, I think that you would have some action for firing you for looking for another job. However, your damages would be limited as you most likely were an employee who could be fired at the will of the employer so the employer was under no obligation to keep you employed. William S.
