Child Abuse

My granddaughter has been taken from her mother by the County of Wayne for abuse. Her and her siglings have been removed from the home and a warrant for the arrest of the step-father and mother have been issued. Now my question is, my son's name is not on my grand daughter's birth certificate, what rights do I have. Can I petition the court to order a DNA test to show that my son is her father and that I am her grandmother. Please advise.

Is your son agreeable to submitting to a DNA test? It is possible for him to petition the court, but I have my doubts that you would be able to, I would have to research that. But I highly recommend you see an experienced family law attorney right away. Certainly the county would want to place your granddaughter with family rather than a stranger, as I assume that is the reason you are concerned about proving this.
