I wanted to know if a step parent adoption through the court-house is just as good as paying a lawer if nothing is being contested byt the biological father? My hisband has always been present for my daughters life from the age of almost 1 1/2 years old and he would very much like to adopt my daughter and if there is no problems on the biological fathers part, would it be as legal as with using a laywer?My daughters real father has never really been apart of her life, he didn't never see her till she was 2 1/2 years old and then for 6 months he would do very well with every other weekend visit then 6 months would go by and we would hear nothing and this has gone on for several years and may 5th 2001 was the last time that we have seen or heard from him until the 7th of May 2002 and I am fine with that myself and my daughter has seemed to be fine with it as well, we have talked about this adoption with her and she would really like this but we don not want to take a wrong turn and something later on be wrong if we choose to go through the court-house without a laywer, do we or should we get a lawyer for this?

Greetings; At no time are you required to have an attorney. However, the fact that you are 'asking' whether you need one, really answers the question. That is to say, yes, you would be better off with one. If this is realy something you want to happen, why leave things to chance. An adoption is a major event. I suggest you treat it as such. You don't have to use a lawyer for anything. However, since this is probably the most important thing you will do in years, I would go to an experienced probate attorney who is well known in your area. It's like watching a sport. The pros make it look easy. Bill Stern
