Divorce

I would like to know what a divorce will entail and how quickly it can be gotten when there are no minor children, but a few assets to be considered, primarily a residence and credit card debts.

Hello,

I have received your post regarding divorce. Michigan law requires a minimum wait of 60 days where there is a divorce with no children. If you and your spouse can reach an agreement on property settlement, you would be able to be divorced in 60 days. I would hope that you could reach an agreement without the necessity of numerous court hearings. If you are unable to reach an agreement, the matter could take as long as one year. Normally, the minimum time to start and complete a divorce is 4 months. It can take a year or more if arguments occur. It is best to just see a divorce lawyer.

Customarily, an uncontested divorce without children would take around three (3) to four (4) months to finalize. Under Michigan law the parties must wait sixty (60) days. After that, assuming there is an agreement as to property, a Final Judgment of Divorce can be entered. Some divorces require hearings. Procedure depends on what county you reside in.
