Grandparent Rights
My daughter is in a bad relationship with 2 children 4 and 5 months - they are not married but live together. He drinks and uses drugs and upon our arrival home from celebrating my granddaughters birthday in Disneyworld ( my daughter and kids came with us) she found him in bed with another woman - beer bottles all over - weed on tables - and passed out. My granddaughter witnessed this and has been living in these conditions since my daughter took uu housekeeping with him. I have had 6 years of seeing these things happen and now I fear for the kids. What rights do I have as a grandparent in pursuing legal custody?

If your daughter files for divorce, you can petition the court for visitation. If she does not, your options are limited to notifying officials to have the kids removed. Of course, then you may not get the kids and they may wind up in foster care. The practical answer is that you should encourage your daughter to leave the relationship and fund the divorce, making it very clear that if she returns to that environment, you wash your hands of it. Give her a break and a chance. It is up to her to take advantage. It is sad for the grandchildren but your powers are limited. William S. Stern
