Where do I stand
I am seeking a divorce. My husband is an alcoholic and I want to leave.
Our house is both of our names, and so is one vehicle.
We both work full time, but he makes a makes more money.
We have four children, three live with us and one lives with her mother. We share one child. One living with us is 19 yrs. of age
I want to settle out of court, and I am asking for ten thousand dollars cash, with no strings attached and I want the house out of my name.
I need to know if this is a fair claim? how can I keep it out of court?

You ask a very good question. But you should know that in a divorce, one of the key factors in property division is the length of the marriage and the needs of the parties. Other factors often are involved.
I think you may be entitled to more than what you've listed. And the process can be rather stress-free if handles appropriately. Consider consulting with soeone in your locale...

Unfortunately, if you want a divorce you must go to court - if however, what you are concerned about is a quick relatively 'hassle free' divorce then I think that is possible in your case. Given the facts you have mentioned, a divorce could be obtained in as little as 60 days. I am not sure about your proposed settlement because I do not know about the rest of your finances - but if you own your home and your cars and you are only asking for 10K I think that sounds low.
