Switching Residency To Affect Divorce Outcome

My husband and I are Michigan residents. My husband works in Wisconsin. He has left our primary Michigan residence and is living in our secondary Wisconsin residence. While we are still legally married can my husband change his residency to Wisconsin and then can he file for divorce in Wisconsin instead of Michigan? If so, how do I go about determining which state might better meet my needs?

If he's living in Wisconsin, he can change his residency to there. You would need to talk to a WI and MI attorney to determine the best course of action for filing a divorce if that is what you desire.

In Michigan the filing individual must reside in the State for 180 days and in the County for at least 10 days before the filing of a complaint for divorce.

If you have minor children, you may want to consult with a local attorney regarding custody issues, many attorney's in your area usually practice in both Michigan and Wisconsin due to the proximity of the two states borders.
