Legal Question in Civil Litigation in Michigan

Cameras in restaurants/malls?

Is it against the law to bring cameras or video cameras into places such as stores, restaurants and malls?

For example -- the other day my friends and I were in a fast food restaurant and had a digital camera and were taking pictures of them (theyre a band).

An employee about jumped over the counter at us and was yelling that we had to leave because cameras in places like that were illegal and if we stayed he would take the camera from us.

So is bringing a camera into a place like that illegal? If so, why?

Re: Cameras in restaurants/malls?

It is not illegal but the management of a private establishment has a right to prevent pictures from being taken. What you should do to put the punk in his place, is contact the manager and explain that you are the representative of a band and would like to use his establishment to take pictures. If you get any into any magazines, tell him you'll give him a plug. Then return and the hamburger flipper will be put in his place. Explain to the employee that 25 years from now, he will still be slipping burgers.

Mr. Stern is correct in that you do not have a right to take pictures within an establishment. I seem to recall a case having been dismissed in which a man sued because he was thrown out of a store for bringing his personal computer in to try to log prices for comparison shopping. So, in the future you might clear what you're doing at the management level. You'll get more with sugar in this case than with meanness, and I can see a few reasons why you could be thrown out for taking pictures. The other thing to consider is that you can run afoul of rights laws if you take pictures of other people, other customers and use them for marketing purposs without their consent.
