civil dispute

two things. One have been involved with a creditor taking me to court, one because I was behind 3 months of $50 per month, which was paid. They took over $1000 out of my checking account without my knowledge. Now say they are going to garnish my wages at work of 1/3rd. Is this legal? I was set up to pay them $50 a month. now am caught up but they still want to garnish and say they are going to. also, ex-girlfriend is suing me for money I paid her back but have no proof that i did. What do I do in these situations?

In order to prevent garnishment of your wages (25% of net wages is the maximum allowable by law), you can file a Motion for Installment Payments and write in the amount you can afford to pay based on your income and other obligations. You can obtain this form from your district court, usually for free. You will need to provide your employer's information and income information as well as list all of your monthly obligations. The form must be notarized before filing it with the court along with a filing fee of $20.

If you have no proof that you paid your girlfriend back money she loaned you, you have a problem (assuming she has proof that you loaned her money). Does she owe you any money that you can offset against money you owe her?
