Legal Question in Civil Litigation in Michigan

Failure to file satisfaction of judgment form

My vehicle was illegally seized to satisfy an illegal judgment, that I was not notified of. I went beyond my obligation to find this out, and was old there was no judgment. The time allowed for a judgment, was exceeded. Its illegal to take an asset worth more than twice the judgment. My vehicle was worth many times the amount that I was sued for, so it obviously satisfied the judgment; but the plaintiff refuses to file Satisfaction of Judgment. This being on my formerly perfect credit record has not allowed me to get a credit card, or to move, worse, I have lived in constant fear that they will return and take more. This fear and stress has resulted in intestinal distress, and lack of sleep which has caused frequent illness. That is why the plaintiff is required to file Satisfaction of Judgment. There is a form that I can file regarding their failure, which also entitles me to some compensation for my losses, and pain and suffering. What is this form called? And how much can I ask for? Can I include my legal costs? The cost to get my vehicle back? The lost wages that resulted from this illegal seizure? Can I include anything else?

Re: Failure to file satisfaction of judgment form

Sorry, but there is no such form. I have discovered from being a participant on this website that there is a mistaken perception out there that the practice of law is all about finding the right form. If that was the case, I and my fellow attorneys could have saved ourselves a heap of money and work by not going to law school and instead, invested in learning the art of finding the right form. Unfortunately, it seems that you will need to file a motion for which there is no form. You can give it a try yourself, or contact a attorney who will do it properly. Sometimes, though, if you do it yourself, but don't do it the right way, a kind judge will help you out. Other judges are just plain irritated when non-attorneys try to practice law and create more work for them.

Good luck.
