Internet law slander and defamation
A forum ahs postings making bad remarks toward a business, the business is breaking the law, etc....
can the sender, though using a fake name, be prosecuted?
if the forum says it is under the 1st amendment and that is the reason for its existence can they be in trouble for letting the remarks happen?

The people behind the site can be sued for slander. First amendment only protects opinions. When they tread into facts, such as you are a bank robber, etc., then they have crossed the line. the problem is the person behind the site may be uncollectible.William S. Stern
