Painter attempting to collect payment

My brother is a painter. He is trying to collect payment for a job he did for one of my coworkers. He went to small claims court. It was moved to civil court because the homeowner wants to pursue the fact that he is not yet licensed. Is there a defense for him? Thank you for your consideration of our question.

I don't believe that painters have to be licensed. If they did, then a painter would need a license for any work over $600.00 and to file a lien. It sounds like the claim is less than $3000, since it was orginally filed in small claims, so it may be tough to justify an attorney - but you should consult with one nonetheless to determine if it is worth it to pursue this claim against the homeowner.

On a different note, it would be tough for the homeowner to justify nonpayment just on the fact that the painter is not licensed.
