Tenant has not signed new lease

I am a landlord and have given a new lease to our tenant. They have not signed it or returned it. The rent has gone up. I do not want to evict them they are good renters. By them not signing is that impling that they accept the contract. How do I get them to sign? Jean

If they did not sign the new lease, then they are month-to-month tenants. Consult local counsel about this, but their right to remain is limited. You cannot "make" them sign the new lease, only pay whatever month-to-month rent you imposed pursuant to their original lease.

Your previous/original lease may have contained a provision for a "holdover" tenant, which would state what rent is should the tenant remain beyond the original lease term. The tenants are now month to month since there is no new lease. If you want to increase rent, and there was nothing in writing, simply provide them with 30 day notice that rent is increasing, and then they have to pay the higher rate or move out.

Call them everyday to sign the new lease - there must be a reason they are pushing it off - maybe they are not sure about committing to one more year.

If they are good tenants, you might just want to see how it plays out. If they keep paying rent, then leave it alone.
