MRSA infection after surgery
My husband had surgery on his elbow. Two weeks later, he was hospitalised with a staph infection, MRSA. This required 5 more surgeries over a period of 1 1/2 yrs reulting in him losing his job and having limited use of his arm. Can we sue the surgeon and the hospital?

You have to assemble your medical records and a timeline of the case and have it evaluated by an "expert" in elbow surgery and/or post operative care. You have two years from the date of the injury to sue. The two year period may be extended if you file a timely NOTICE OF INTENT TO SUE. Thereafter you have to have your expert sign an affidavit of merit.

A medical malpractice lawyer can consult with a surgeon or other medical expert who will give an opinion as to whether your his care providers breached the standard of care causing your husband's damages. Precautions are supposed to be taken preventing staph infection. Get the medical records, keep a copy for yourself, and send them off to an expert lawyer.
