Legal Question in Medical Malpractice in Michigan

Two Surgical Mistakes

I am currently 27 years old. I had surgery for endometrioses when I was 20. I woke up during the surgery. I noticed extremely increased pain after the surgery, but after several attempts to identify the problem, no doctor could pinpoint anything. At the age of 22 another surgery was attempted to see if endometriosis was still the problem. My intestines were cut open, a 6-inch long blood clot was found, etc. By the end of the surgery I had over a dozen incisions. I have not been able to go through more than two weeks without extreme pain since. I have not been able to find a doctor that could pinpoint the exact cause of the pain yet. Do I still have any options after so much time has passed?

Re: Two Surgical Mistakes

Even if you found a doctor that said he knew the exact cause of the pain, his testimony would be countered with lots of other doctors challanging his opinions. Furthermore, the statute of limitations in a medical malpractice case in Michigan is two years from the date of the exact malpractice. Although there is a six month period that extends the time in the event you find any malpractice, odds are in your case it would not apply to you because you knew of the bad result years ago. There is another statute that prevents you from suing under any circumstances after the passage of 5 years. So my opinion is that it is impossible to proceed.
