Legal Question in Traffic Law in Michigan

Parking Ticket

I received a parking ticket. I ignored it, hoping they'd forget (yeah, right). I received a default judgement- except the postcard was addressed to my deceased husband, to whom the car technically belongs. Do I have to pay?

Re: Parking Ticket

Okay, silly question - was he alive when the ticket was issued? If he wasn't, then they will know it wasn't him who got the ticket.

Assuming he was alive, I would respond by sending them a letter and a copy of his death certificate informing them that he is deceased, and that there is no money in his estate which could be used to pay the ticket (assuming this is true - make sure there is no probate estate currently open for him).

I would think they would just write it off and not bother with it anymore. It's worth a shot.

Thanks and good luck.

Re: Parking Ticket

You don't HAVE to do anything. The consequences of your inaction may or may not occur - like having your car impounded the next time you park in the same city. If you like to take risks, not paying is the way to go.

Re: Parking Ticket

YOU received a parking ticket. It's YOUR debt. It doesn't matter to whom the car was registered.

If you get a parking ticket on a rental, it's still your ticket, not the rental agencies debt.

[lawabby] Eh...just pay the darned ticket!! Unless you have some hidden desire to be punished (because you're not going to win this one) or have some fascination with having a prolonged relationship with the government, you're better off not wasting your money this way. Go see 10 movies instead! If you really want to waste money, I'll put my list online just for you! [/lawabby]
