Legal Question in Wills and Trusts in Michigan

last will and testament question

My father just passed away. Me and 3 of my siblings are wondering if he has a will and are we in it. He was divorced from our Mother 13 yrs ago. His 2nd wife also has 4 kids from another marraige. Before he died I think she was given power of attorney. My questions are: can we see his will before it is executed and can his 2nd wife change anything in it that he might have left for us kids? I do not want to start a nasty battle with anyone but I feel like we should know what is in it in case some things change and we will never know what he originally left for us.

Your father's second wife cannot change his Will. Only your father could have changed it during his lifetime (provided he had proper mental capacity to make changes). If a probate estate is opened for your father, the Personal Representative of the Estate must send you a copy of the Will. Our office handles matters like this on a regular basis.
