The answer may depend on whether it is fleeing in a motor vehicle or on foot. Fleeing in a motor vehicle is a felony under statute 609.487. A person may be sentenced to imprisonment for not more than three years and one day or to payment of a fine of not more than $5,000, or both.

Fleeing on foot is a misdemeanor punishable by up to 90 days in jail and a $1000 fine.
