Legal Question in DUI Law in Minnesota

My rights

Is it OK for my plates to be removed from my van without telling me? The law enforcement did not see me in or near my van nor did I have the keys with me. I didn't even know where my van was. I was at home when they took me to jail.

Re: My rights

The answer depends on why your plates were taken and other facts. If your plates were seized for a DWI that was yoru second or more within ten years, the police may seize the plates and provide you with a later notice of that seizure.

Re: My rights

The facts in your quesiton are incomplete, but it sounds as if the question is whether the cop had probable cause to arrest you in the first place.

I have recently posted an article about a Minnesota case which just came out and deals with this issue at my blog. Go to: http://www.mn-bankruptcy-dwi-probate.blogspot.com/
