Legal Question in Family Law in Minnesota

child support

I have some basic questions about child support. My ex husband is taking me back to court. He wants to decresse how much child support he pays along with other things. My first questions is Does his wifes income need to be included in his total income? He also wants to get his arrears taken off, can that really happen? He is not putting all of his information on the papers. He has 2 jobs Does that need to be included? And I also know that he is lying on some of the questions. What do I do about that?

Re: child support

His wife's income is irrelevant to the calculation and is specifically excluded by Minnesota Statutes. He should, however, be including all of his income from all sources, though he may argue that any income from a second job should be excluded for purposes of calculating support.

You should perform discovery and acquire the necessary evidence. Hiring counsel would be a very good idea.
