Custody

my husband had an affair and our marriage is good but we found out in August that she birthed a child and DNA tests have proved that it is his, we have made attempts to contact the mother and received only one response via email indicating that he wanted nothing to do with her, which is not the case, once it was confirmed there were numrous attmepts to contact her, that have been documented, the court is appointing sole custody to her, along with 250.00 monthly support and 100% of all medical and dental, but Chris would like his deserved right as a father to be part of his childs life, and we feel that we are cheated out of this. While we can't afford a lawyer, we do need some assistance in this matter. What do we need to do to make sure we are treated fairly and get the custody and arrangements that deserved.

Your question regarding custody is far too complicated to answer in this forum. For purposes of this response, I presume the mother of the child lives in Minnesota. If she lives in Wisconsin, you will need to contact a lawyer in that state.

As a general matter, you will need to commence a custody proceeding in the county where the mother of the child lives. Minnesota has forms available for self represented litigants. These are of the "fill in the blank" variety, and most definitely are not a substitute for the work of a competent lawyer. Nevertheless, they may be of use to you. You can find them if you do a google search for minnesota court forms, or at this address: www.mncourts.gov/?page=513.

You must file an action to confirm paternity and to determine custody and parenting time. Until an action is filed in court and there is a resulting order, there are no enforceable parenting tights.
