Divorce

I left my abusive husband in 2005.It has been 4 years with no contact. Now I cannot find him and want a divorce.Do I still have to file? Is there a statute that exists that would allow me to already be divorced?I am in Minnesota and I think he is in arizona.

There is no statute like that, but you can get a divorce even if you cannot locate the other party. This is something you should have an attorney do for you, however, to ensure proper service and court procedures are followed to obtain a valid default divorce judgment. You must still seek a divorce. In that divorce, you must demonstrate specific efforts were made to locate the other party. if they cannot be found, you may file a Motion seeking to serve that party by substitute service (usually by publication). The notice of the divorce action is then published in three consecutive weekly issues of the newspaper. If there is no Answer failed, you may then seek a dissolution by default.
