Registering a judgment

I have a judgment against a debtor. How can I register my out-of-state judgment in Mississippi?

First step is to order a Congressional Certificate from the clerk of court, along with a certified copy of the judgment. There are fees associated with those services. That package is sometimes referred to as an exemplified judgment.

Next step is to find a lawyer in Mississippi, preferably in the county where you want your judgment enforced, to enter a sister-state judgment under the Uniform Enforcement of Foreign Judgments Act. That means filing your exemplified Texas judgment in Mississippi in a court of competent jurisdiction. That is the equivalent of having a judgment rendered in that state, on the date of filing, and gives the judgment debtor a window within which to file an appeal or collateral attack.

You will need a Congressional certificate and a Certified true copy of the Judgment.

You did not state which County in Mississippi the Debtor resides as the Judgment is

preferably registered in that County. Do you have enough information on the assets of the Judgment Debtor in Mississippi. An attorney will be able to assist you in this regard.

Don't forget that the Judgment must also be a final judgment to be accorded full faith and Credit in Mississippi.
