Legal Question in Family Law in Mississippi

Getting a Divorce

If my wife does not want to sign the divorce papers or she cannot be found then what will or can happen? We have no children together, no land or property, and have been living in different states for 2 years.

Re: Getting a Divorce

If you live in Mississippi and can't find her, you can still divorce her through service by publication. The whole process is rather simple. Contact me if I can be of further assistance.

Re: Getting a Divorce

There are two different issues raised in your question. The first is getting jurisdiction over her person. If she is hiding, or cannot be found through due diligence, an Order can be granted by the court permitting service by publication.

AFTER she is served, if she does not sign, you can obtain a divorce by default.

Of course, she could also contest the divorce.

If you wish to discuss this with me privately, please call to schedule a consultation.

I practice in NYC & Long Island.
