Legal Question in DUI Law in Missouri

suspended license

This is the second DWI in two years. Still on probation from first. Passed all field sobriety tests, refused to blow. Can I get a hardship license to drive to work? How long will my license be suspended? Will I go to jail for breaking my probation? Is there a chance a lawyer can help me?

Re: suspended license

As you well know you are facing some very serious trouble. Your post does not tell us whether either or both of your recent DWI's are in Municipal court somewhere, or if they are in the State Court system. This might make some difference. I have handled many, many clients with multiple DWI charges, and it is possible to work out some kind of plea arrangements which will benefit the client. It is also possible that you have a defense to the second charge. Usually, the prosecutor will seek to revoke the probation on someone who picks up a second charge while still on probation. But, you are entitled to a hearing on that revocation. You may wind up with a conviction on your record if you received an SIS on the first charge, and in fact it is possible that you may take a conviction on the second charge as well. This would probably mean a five year suspension of your driving privileges with no hardship license. You definitely need to hire the very best criminal defense attorney you can afford and as quickly as possible. If you are located in the Eastern half of the state, I might be able to help you. You may call me for a free telephone consultation at 314-727-2822. I would also be willing to give you a brief consultaton in the office in order to determine whether I can help you or not. No matter what you do, I hope that you learn something and survive this episode so that you can drive agian in the future without drinking and driving.
