My mother and father quit claim deed there house to me in 1985- He past away several years ago- My mother past away Sept 2009- At that time my brother was living with her along with his daughter for the past 6 years. there is a loan on the house in my name- when my mother died we verbally agreed that we each woyuld pay 1/2 of ther loan and he could stay there. the loan is a combination of all of our borrowings. In Feb he had a girfriend move in along with her daughter, He lwas fired frome his job in Feb. Sinc Jan I have received no money on the loan. He is not willing to talk to me about this. what are my options? can they be evictied? There is nothing in writing and there is no landlord / tentent. I was just being kind to my brother letting him stay there paying no rent but expecting him to pay his part of the loan.

It sounds like you a verbal lease. The rent was a portion of the loan. If you recorded the quit claim deed, you are th owner of the house. If you di dnto, you may not be the owenr of the house. If you are the owner, then you can evict your brother and the other occupants. If you wish to discuss how to do it, pleas email me direclty or contact an attorney in your area.

Good Luck
