Legal Question in Wills and Trusts in Missouri

Dads will and trust.

My father had a will and trust created in Illinois about twenty yeras ago. He has updated and made changes thru the years. Last year we move to Missouri and now he is in ill health. Questions. If he passes is his will and trust valid in Missouri? Does he have to have a new ones created for the State of Missouri? Or is there some sort of reciprocal between the two states? Thank you.

Wills and trusts are valid in all 50 states, regardless of the state in which they were drafed, so long as the execution requirements of the state where signed have been met. Trusts in both Missouri and Illinois need only be notarized (actually they don't have to be notarized, but ususally are). Wills need at least two disinterested witnesses and are ususally notarized, although notarization is not required. I will be happy to help you, should you need it. If your father's healthcare power of attorney was not drafted within the past year or so, it should be updated to comply with changes in federal law that have recently occured.
