Father passed with out a will and he was married.

My Father just passed away and he was married and no will, do we have any claim to his insurance or 401k or anything?

The answer would depend upon whether your father named you as a beneficiary under any insurance or as to his 401K. Also, you may be entitled to one half of aything that he owned in his own name at the time of his death. Please consult with an attorney.
