Legal Question in Wills and Trusts in Missouri
Our money was taken, what do we do?
After mom died in 2006, a signed signature card only was added to dad's checking account for one of our siblings, with no POD or TOD assigned.
Dad restated his trust a three months after the signature card was added to the account.
The title of the account is dad's name, trustee. Second line is dad's name living trust.
All of the money in the account, was put in by our dad, our sibling did not add one cent.
My dad took ill and finally died about 6 months ago.
The rest of the kids in our family have been waiting to receive their share of the money from these accounts per the instructions of the trust. Today, we found out that the sibling with the signature account emptied dad's bank accounts of all money while he was
in his final months of life.
How do we get this money back?

Re: Our money was taken, what do we do?
I'm still not clear how he had access to an account titled in your dad's name as trustee. Was he using a power of attorney?
In any case, if he is improperly holding property belonging to your dad's trust/estate, you could open up a probate estate and file a citation to discover/recover against your brother and then obtain all of the info and lay out your case against him.
