Legal Question in Criminal Law in Nevada
assault threat?
i've been charged with misdemeanor assault, to make the story short i witnessed a couple of teenagers kicking a dog while it lay prone on the ground whimpering, so i pulled over and yelled at them - something along the lines of ''if i see you kick that dog again i'll come out of this car and kick you'' (i had witnessed similar behvior before)
anyway, over 15 hours later they call the police and by now they're saying i threatened them and said i had a gun - which doesn't look good because i keep an unloaded but very realistic BB gun (without co2 cartriage) in my car. anyway i'm being charged with misdemeanor assault now, i have a completely clean record, and where my threats were all conditional on their future comission of a second crime, i'm not even certain this is applicable - basically i want to know how i should go about fighting this, and what they'll do to me if i lose. I'd also like information about filing a counter-suit of animal cruelty, i want to see these kids get some therapy or something.

You must be careful when you touch a child under 18 unless it is in self-defense. I would suggest you get an attorney to work out a dismissal. It is up to the District Attorney at Family Court to charge the boys with animal cruelty. The only thing you can do is file a report with the police. Insofar as rescuing the animals perhaps you can use that as a defense to the assault change. But it would have helped if you called the police before the boys.
