Legal Question in Family Law in Nevada

insurance pay out during divorce...

husband and I have been living apart for 3 months. We have filed no papers yet and are currently in agreement of everything, including custody and support.

His Father has passed away. He will more than likely get some money through insurance and or inheritance pay out.

We don't technically share bank accounts anymore, but both our names are still on all the bank accounts.

Would I be entitled to a portion of any money he recieves? I was told inherited property is different than money.

Inheritance and life insurance proceeds (along with personal injury payouts) are considered seperate property. Even if you were still together, he could put them in his own account and they would not be part of the assets to be distributed by the Divorce Court.

As far as your divorce is concerned, if you are in agreement you can do a Joint Petition which is fast, easy and inexpensive. You don't even have to go to court.
