If you all agree on the terms of the agreement, one attorney can prepare it for you. However, if the terms have to be negotiated, you and your partners each have to have their own attorney to make the agreement enforceable. Our office can help you prepare an agreement or represent you in negotiating an agreement. If you want more information, please call for an appointment. Mention lawguru and receive the first half hour free.

Re: employee hiring practice

My office regularly prepares such agreements for businesses and therefore could do so for you as inexpensively as possible. It is in your favor to have all partners in agreement, which it sounds like you all are, prior to preperation of the document. Have a good day.

Re: employee hiring practice

Presuming that all partners are in agreement, there are no terms to be negotiated between them, and they are willing to waive their right to independent counsel, a single attorney or firm can represent them all. There are many terms and situations to cover and consider beyond what you have written about (such as buy-outs, sale of interests, what happens if someone dies or becomes disabled, insurances to cover these situations, etc.). Be sure that you use someone who has experience in these matters and can not only explain variable positions, but can mediate potential conflicts in the decisions to be made. I have 40 years of experience in these matters, if you desire my assistance.

Please make sure, by asking the attorney, that the attorney you hire has experience representing small businesses, drawing contracts and making agreements among owners of businesses.
