is it illegal for an employer or potential employer to discriminate based on a persons credit worthyness?

No.
An employer can check your credit and use the results for determining whether to hire, fire or promote you.
With that said, before an employer can check your credit they must get your written permission.
Also, if the results of the credit report form the basis of their employment decision they must give you a copy of the report and give you a chance to challenge any inaccuracies contained in the report.
