Legal Question in Technology Law in New Jersey

Computer file Distribution.

I asked a question a while ago concering a situtation where the accused is being told that a file was distributed. The only evidence that the police have in their posession is the identified file on the computer, and the html based chat log from AIM that states the date and time the file was sent. His lawyer is telling him to research this. My question is can these chat logs be used in court if there is no supporting documents from outside the computer, the isp, aol, aim, or even the individual they say it was sent to. His laywer states the chat is self authenticatiing. I would assume just because a log file states something was distributed, it would need more than just a line in a chat log. The chat log could be manipulated within a word processing program. It would be like typing that he just robbed a bank, saving the file, and they fine a dollar bill on the floor. Also, what other options are there to determine that a file was actually distributed. He was told that the chat log is suffiecent to prove distribution or is more needed?. Also, does the decsion in Crawford v Washington hold any merit in this situation. Please help, Thanks Alot for your time

Re: Computer file Distribution.

Please do not take any offense, but I am not about to do your attorney's job for him. In my opinion, you pay yout attorney for THEM to do the work, not YOU. Thus, I would suggest getting an attorney than handles a lot of computer crime cases so that you don't have to do your attorney's work for him.

My initial consultations are always free, so call me at 732/247/3340 to discuss your case.
