Legal Question in Consumer Law in New Jersey

Getting money back

Purchased a ventless gas fireplace in October. Asked the salesman if there was anything I should know about...i.e., smell, anything dangerous in the air, etc. Never dealt with gas before. He said, ''no.'' However, it really stunk up the house and left a film on all the mirrors and windows. Looked up on the internet and found a ton of things wrong with them. Asked the store to come and get it and for our money back, or at least some of it back. He said, ''I can't help you and I'm not eating it.'' He was a different person. I've checked the BBB and there is nothing on him. It costs $2,000 and we feel helpless.

Re: Getting money back

find a consumer protection lawyer, see if you can sue the pants off of them. I am in north Jersey. The only guy i know who says he does this work is: Glen H. Chulsky in Ledgewood.

Good luck. Lousy situation.

Re: Getting money back

A lot depends on whether or not you can prove that the salesman or anyone acting for the seller or manufacturer made any statements that turned out to be false. Proof is the issue and in a your-word-against-theirs contest, you lose because you are the plaintiff. If you have any material in writing, it becomes more interesting. Then there would be a possibility of a complaint under the Consumer Fraud statute.

So, if you have some claims documented in writing or testimony of a disinterested witness with credibility, give me a call. Remind me that the contact comes via this question on Lawguru and the first consultation will be free.
