Legal Question in Criminal Law in New Jersey

bank fraud

suppose an individual took a payroll check from a fellow employee at a company.

then took, without permission, another employees' personal vehicle to a bank and

tried to cash the stolen check stating that the check was 'signed over to him'.

then when told to wait a minute he leaves the bank quickly. leaving the check behind.

on his return to the company he declines any knowledge of the whereabouts of the keys to the vehicle, nor does he know why the engine is hot. even though two customers saw him exit the vehicle. the keys are never returned.

the video tape at the bank clearly indicates the person who tried to cash the check.

what COULD be the WORST state and federal penalties in this case?

There are a lot of possible charges, but here are a few possibilities:

Check - Theft - petty or grand larceny depending upon the value of the paycheck, forgery, conversion (civil), robbery (assuming her 'entered' another's desk, cube or office to take the check)

Car - theft, grand larceny

There are other possible charges, but the way it generally works is the offence with the greatest penalty will dictate the max sentence, with any other charges running concurrently. If this is a first time offence, this person could even get off with probation under a diversionary program.
