Legal Question in Criminal Law in New Jersey

possesion with intent

is consider a second degree offense according to the summons and it happend to a person with a clean record, nothing ever done in the past. is probation an option, would the state consider giving a secong chance before ruining someone's life or was this a ticket to jail without a doubt?

Although each case is unique, second degree possession with intent does have a presumption of state prison time if you are convicted. There may be ways to avoid prison, or even beat the case, but I would have to see all of the evidence before I could give a full assessment of how the case can develop. In my opinion, probation will only be an option if you fight the case hard and you show the State that you are willing to give them a run for their money. Thus, unless you get an attorney that has the guts and the experience to fight this case, you may not ever get a probation offer.

You should ask whatever attorney you speak with for examples. Even though every case is different, it will at least give you an idea that the attorney fights for his clients. For an example, just today I had a client with 17 drug counts in two indictments, including a 2nd degree weapons charge. Got her a plea to two counts of third degree conspiracy. She'll probably get probation without any jail time.
