Legal Question in Family Law in New Jersey

My husband told me that he did not want me in the house when he got home from work. He said he would have the police there to remove me. Can he do this? He says I am mentally abusing him. There has been no infidelity or domestic violence.

The only way he can remove you from the home is to either obtain a temporary restraining order that gives him possession of the home, or if there is a pending divorce or other family type litigation, to ask a judge to remove you from the home. If you get served with legal papers you need to seek the advice of an attorney immediately.

I would be happy to follow up with you. Please email me directly or call my office if you would like to schedule an appointment either in person or by telephone. My contact information is listed in the links below.

No, he can not just call the cops and toss you out. That is crazy. It sound pretty clearly that you need a divorce attorney right now.

What often happens in these cases is that the party seeking to get you out will make something up and the police will often buy it, especially if there is an alleged injury. As the other attorneys said, call an attorney right now. Feel free to call me anytime at 732/773/2768.
