Hello,

I am female on h4 living in New Jersey for more than 2 years. i got married in July 2009.

I got married in india under hindu marriage act. my husband moved out of house 3 months back and living separably in nj. lately i learned that he is planning to apply for divorce in NJ ( AFTER 6 months of separation). i am planning to apply for injunction from indian court so that he cannt apply for divorce here.

is the indian court injunction valid in nj?

is there anyway i can protect my status?

can he withdraw affidavit of support?

An injunction issued by an Indian court is valid in India. New Jersey is a state within the Unites States of America, not India. I always find it curious that people from India do not understand that in New Jersey the law of India does not apply.

You need to consult with an immigration lawyer. You may not have the immigration problem that you imagine. The courts of New Jersey will protect you and your child. Why do you look to India for protection.
